Recent Legislative Changes

Changes have recently been made to the language used to refer to child custody. What used to be known as child custody is now known as "allocation of parental responsibility" or "allocation of decision-making responsibility." The language was changed in an effort to encourage parents to think about children as people rather than property. Physical custody and visitation is now known as "parenting time." We have observed that the trend among many judges and magistrates in the last few years has been starting with the idea of joint decision making, and shared parenting time, and then modifying this view as the facts may warrant.
