Property Division

Colorado Marital Property Division Lawyer

Colorado is a community property state. Property, assets, and debt in Colorado are divided equitably. "Equitable property division" does not necessarily mean "equal property division." Any property that was accumulated during the marriage will be considered marital property and is subject to the division. Watts & Hendrickson, PC offers clients assertive advocacy during the process of asset division.

Three Stage of Marital Property Division

Attorney Dale Hendrickson uses strong negotiating skills and his experience in the local court systems to advocate for his clients, their right to property, and to ensure their contributions to the marriage are accounted for. Property division generally moves through three stages.

  • Property and debt are classified as marital or non-marital.

  • Monetary values are given to property and debts.

  • The property and debt are distributed equitably.

As property is divided, it is important to have an experienced attorney advocating for your best interests and ensuring your contributions to the marriage are considered. Many types of property and assets can be divided, including:

  • Marital house

  • Equity

  • 401(K) and other retirement pay

  • Cash

  • Savings

  • Businesses

  • Furniture

  • Art

  • Jewelry

  • Vacation homes

  • Recreational vehicles such as boats, RVs, and motorcycles

Alimony (spousal support) is also decided during the division of property. Colorado does not generally favor alimony. However, in certain circumstances, such as in the event of a long marriage, the court may grant support.

An important aspect of marital property division involves a full disclosure on behalf of each party about property, assets, and debt. The income of each party will be taken into consideration as well as the future earning capacity of each. Contact Watts & Hendrickson to learn your legal options and marital property rights.
